Case summary: U-BOX and U BOX IT found to be confusing

The appellant, U-Haul International Inc., saw its trademark applications for U-BOX and U-BOX WE-HAUL in association with “moving storage services, namely rental, moving, storage, delivery and pick up of portable storage units” denied by the Opposition Board and the Federal Court because they were found to be confusing with U BOX IT, a mark that was registered by the respondent in association with “garbage removal and waste management services.”

116 Inc. applied to register the trademark IRRESISTIBLES for “candy and snacks, namely…cookies & biscuits.” The application contained a use claim date of August 2001 in association with those goods. Les Marques filed an opposition against the application, alleging at least that the trademark had not been used in association with each of the goods and services, namely cookies and biscuits, since August 2001.
