Whereas the strategic plan adopted at the 2007 Mid-Winter Meeting in Mont-Tremblant says that the CBA will advocate effective law reform and fair justice systems, and that CBA policy positions will reflect a commitment to the rule of law, the Charter aid fundamental human rights

Whereas CBA Bylaw No. I requires ballots for Second Vice President and Treasurer to be sent to National Council members within seven days after the Mid-Winter Meeting and to be returned by April 15, usually a period of close to two months

Whereas court administration, including adequate physical facilities for the courts, judicial and administrative personnel, and budget, play a critical role in the fostering or eroding of judicial independence

Whereas the Canadian Bar Association has called for each member of the legal profession to strive to contribute 50 hours or 3% of billings per year on a pro bono basis

Whereas the cost of legal proceedings is increasingly beyond the means of the ordinary person

Whereas former students of Indian residential schools need legal assistance that is sensitive to their vulnerability and the potential for further trauma when they address memories of abuse and neglect

Whereas the National Sales and Commodity Tax Section has approved proposed terms of reference and wishes to amend the name of the Section accordingly

Whereas National Sections are governed by the Model National Section By-law or by a Section-specific By-law adopted in accordance with Article 57 of CBA By-law No. 1

The Council shall be known as National Sections Council.

Whereas National Sections Council wishes to amend its By-Law to clarify the purpose of National Sections and update terminology with regard to National Sections Council committees and Members-at-Large
