Nunavut Branch

WHEREAS CBA members resident in Nunavut are members of the Northwest Territories Branch (if they do not opt to be a member of another Branch), and are not served by a Branch in their own jurisdiction;

WHEREAS CBA members in Nunavut have indicated their interest in establishing a Branch of the CBA; 

BE IT RESOLVED THAT:

  1. There be a Branch of the Association in Nunavut, comprising all members of the Association resident there;
  2. The following consequential amendments be made to CBA By-Law No. 1:
    • Article 1(5) be amended to insert "or territory" after "the Bar or Law Society of any province";
    • the French version of Article 6(1)(d) be amended to insert "ou d'un territoire" after "province";
    • Articles 19 (5)(b), 21(1)(a)(ii) and 78 be amended to replace "province" or "provinces" with "province or territory" or "provinces or territories";
    • Article 35(1)(c) and (d) be amended to remove the number "12";
    • the French version of article 35(3)(a) be amended to replace " province " with " division ";
    • Article 58(3) be amended to replace "Provincial Section" with "Branch Section";
    • Articles 61 and 63 be amended to replace "provincial and territorial" with "Branch";
    • Articles 62(4) and 64(3) be amended to insert "territorial" after "provincial";
    • Article 69(1) be amended to replace "the Yukon Territory or the Northwest Territories" with "or territory";
    • Article 69(2) be repealed;
    • the first paragraph of article 71 be repealed and replaced with "There shall be a By-Law of each Branch of the Association for the regulation of the affairs of the Branch.";
    • Article 72(1) be amended to replace "for each Province, for the Yukon Territory and for the Northwest Territories" with "for each Branch";
    • the English version of articles 72(1)(e) and 73(8) be amended to replace "Provincial Council" with "Branch Council";
    • Article 89 be repealed.
  3. The following consequential amendments be made to the Young Lawyers Conference By-Laws:
    • Article 1.0(c) be repealed and replaced with "Section means the Branch Sections of Young Lawyers located in each province or territory"; 
    • Article 9.0 be amended to replace "local Section of the provinces and territories" with "Branch Section"; and
    • Article 10.0 be amended to replace "provincial or territorial" with "Branch".
  4. Articles II.4 and IV.2 of the Financial Policies and Procedures Handbook be amended to replace "provincial" and "province" with "Branch".
