CBA END-OF-LIFE WORKING GROUP

The Section is actively involved with the CBA End-of-Life Working Group which comprises a cross-section of members from diverse areas of expertise, including constitutional and human rights law, criminal justice, health law, wills, estates and trusts law, elder law, child and youth law, privacy and access to information law and alternative dispute resolution.

PROHIBITION ON THE PURCHASE OF RESIDENTIAL PROPERTY BY NON-CANADIANS ACT

The Prohibition on the Purchase of Residential Property by Non-Canadians Act, S.C. 2022, c. 10, s. 235 (the “Act”), prohibits non-Canadians from purchasing some residential properties until its proposed repeal on January 1, 2025.

The initial Prohibition on the Purchase of Residential Property by Non-Canadians Regulations (SOR/2022-250) (the “Regulations”) were published on December 2, 2022. On March 27, 2023, the Government announced amendments to the Regulations to expand exceptions to allow Non-Canadians to purchase residential property in certain circumstances.

The Canada Mortgage and Housing Corporation has published new information on its website that supports the Act and the Regulations, including updated frequently asked questions and answers for individuals and industry professionals.
