Key Public Sector Cases Across Canada: Nelson (City) v Marchi, 2021 SCC 41 – April 8, 2022

This session will address the recent SCC decision, Nelson (City) v Marchi, 2021 SCC 41. The two lawyers who represented the City of Nelson at the SCC will speak about (1) the policy versus operational dichotomy; (2) the impact this decision will have on government litigation; and (3) what needs to be considered as new government policies are created or old ones revised.
