Bill C-23, Preclearance Act

The CBA sent a submission to the Standing Committee on Public Safety and National Security regarding Bill C-23. The submission was prepared by the CBA Immigration Law, Criminal Justice and Commodity Tax Sections, with assistance from the Legislation and Law Reform Directorate at the CBA office.

Bill C-23  implements the Agreement on Land, Rail, Marine, and Air Transport Preclearance between Canada and the US (March 2015), to provide for the preclearance in each country of travellers and goods bound for the other country. The Sections have serious concerns about many aspects of the draft Bill, and provide a section by section commentary in the submission. They urge the government to engage in full consultations, and an extensive review before enacting this legislation, which is so highly intrusive on personal liberties and rights.
