L’Association du Barreau canadien, Division Québec (« ABC-Québec ») est fière de vous annoncer la tenue de son troisième concours de rédaction juridique annuel visant à promouvoir les talents des étudiants en droit. Pour sa troisième année, l’ABC-Québec est heureuse de s’associer à Osler, Hoskin & Harcourt afin d’offrir un concours de rédaction juridique portant sur les obligations contractuelles.

1. QUESTION DE RÉDACTION

M. Piéléger, alpiniste, a conclu un contrat de commandite avec une compagnie québécoise  pour publiciser une marque de chaussures de montagne. Ayant appris que l’entreprise fabriquant les chaussures à son usine en Absurdistan refuse systématiquement d’engager des femmes, M. Piéléger peut-il mettre fin au contrat et obtenir des dommages?

2. PRIX 

Les prix suivants seront décernés aux auteurs des trois meilleurs Textes sélectionnés par le jury de la manière décrite ci-après :

1ère  place :     1 500 $ 2e  place :        1 000 $ 3e  place :        500 $

Par ailleurs, tous les participants ayant respecté les modalités des présents règlements recevront une adhésion gratuite d’une durée d’un an à l’Association du Barreau canadien.

3. ADMISSIBILITÉ

Afin d’être d’admissible au présent Concours, l’auteur du Texte (ci-après « Auteur ») doit répondre aux critères suivants, à défaut de quoi il sera disqualifié :

3.1.     Il doit être inscrit au premier cycle en droit dans l’une des universités du Québec ou à la Section de droit civil de l’Université d’Ottawa en date du 1er janvier 2010;

3.2.     En soumettant son Texte, l’Auteur reconnaît qu’il s’agit d’une œuvre originale, non publiée, qu’il a rédigée;

3.3.     Les dissertations soumises dans le cadre d’un cours de droit sont également admissibles.

4. FORME ET REMISE DU TEXTE

Préférablement, le Texte doit être rédigé à interligne et demi, en caractères « Times New Roman » de taille 12. Afin d’être admissible au présent Concours, le Texte doit obligatoirement correspondre aux critères 4.1 à 4.7 ci-après, sous peine de rejet :

4.1.     Il doit être préparé et rédigé de façon individuelle;

4.2.     Il doit être rédigé en français ou en anglais;

4.3.     Il doit être dactylographié;

4.4.     Il doit comporter entre 4000 et 6000 mots, incluant les notes de bas de page en fin d’ouvrage et les références bibliographiques;

4.5.     Il doit être remis en deux (2) copies, dont une version électronique (en format Word ou Wordperfect) et  une version papier. Les deux copies doivent contenir les renseignements suivants : nom, prénom, adresse postale complète, numéro de téléphone de son Auteur, ainsi que le nom de l’université qu’il fréquente;

4.6.     La version électronique doit être envoyée au plus tard le 31 mai 2010 à l’adresse suivante :

5. SÉLECTION PAR JURY

5.1.     La sélection des trois (3) meilleurs Textes sera effectuée par un jury composé d’au moins trois (3) membres sous la responsabilité de Osler, Hoskin & Harcourt (ci-après le « Jury »).

5.2.     Les Textes seront soumis au Jury de manière anonyme.

5.3.     Dans sa sélection, le Jury tiendra compte notamment des critères suivants :

• Respect de la question posée;
• Rigueur de l’analyse juridique;
• Apport critique;
• Qualité de la rédaction;
• Qualité de la langue;
• Originalité du Texte.

5.4.     Le Jury se réserve le droit de ne pas accorder un ou plusieurs prix s’il juge la qualité des Textes soumis insuffisante.

5.5.     Le participant pourra perdre une position dans le classement final si la qualité de la langue n’est pas satisfaisante.

6. ANNONCE ET REMISE DES PRIX 

6.1.     La divulgation des noms des gagnants et la remise des prix se feront au courant de l’automne 2010.

6.2.     Seuls les gagnants seront contactés. Les noms des gagnants seront affichés sur le site internet de l’ABC-Québec au www.abcqc.qc.ca.

6.3.     Chacun des trois (3) prix sera remis sous forme d’un chèque au nom du gagnant.

En cas de divergence entre la version française et la version anglaise des règlements de participation du présent concours, la version française prévaudra.

Participation Rules

The Quebec Branch of the Canadian Bar Association is proud to inform you of its third Annual Legal Writing Contest having as objective to promote the talents of law school students. For its third year, CBA-Québec is happy to partner with Osler, Hoskin & Harcourt in order to proceed with a contest regarding contractual obligations.

1. ESSAY QUESTION

In order to participate in the contest, the student must produce an analysis of the following question from a legal viewpoint (further refered as “Essay”) : 

M. Lightfoot, alpinist, has entered into a contract with a Québec company to advertize mountain shoes. Informed that the company, which manufactures the shoes in its factory in Absurdistan, systematically refuses to hire women, he now wishes to terminate the contract and claim damages. Can he do so?

2. PRIZES

Listed below are the prizes to be awarded to the top three Essays selected by the jury as described hereinafter:

1st  place :    $1 500 2nd  place :   $1 000 3rd  place :    $500

Furthermore, all participants having respected the required rules of the contest will receive a free one-year membership to the Canadian Bar Association.

3. ELIGIBILITY

To qualify for the contest, the author of the Essay (further referred as “Author”) must satisfy the following criteria, or otherwise he/she will be disqualified:

3.1.     The Author must be registered in an undergrad program of Law in a Quebec university or in the Civil Law program at the University of Ottawa as at January 1st, 2010.

3.2.     Upon submission the Essay, the Author acknowledges that it is an original piece of work written by the Author and that has not been published.

3.3.     Essays submitted through a law course are also eligible.

4. FORMAT AND SUBMISSION OF THE ESSAY

Preferably, the essay must be drafted in “Times New Roman” font, size 12 and the line spacing should be 1.5.

To qualify for this contest, the Essay must respect the following criteria 4.1 to 4.7 or it will be considered void:

4.1.     The Author must have prepared and written the Essay by himself/herself;

4.2.     The Essay may be written in either French or English;

4.3.     It must be typed;

4.4.     The essay must be 4000 to 6000 words long including the footnotes / endnotes and bibliographical references;

4.5.     The student must hand in two (2) copies: a soft copy (Word or Wordperfect) and a hard copy. Both copies must containe the following information : Full name, Complete mailing address, Author’s Phone number, and the Name of the University he/she is attending;

4.6.     The soft version must be sent by May 31th 2010 latest to the following e-mail address:

5. CRITERIA FOLLOWED BY THE JURY

5.1.     The selection of the three (3) best Essays will be made by a jury composed of at least three (3) members under the supervision of Osler, Hoskin & Harcourt (hereafter referred as “Jury”).

5.2.     The Essay will be submitted to the Jury anonymously.

5.3.     During its selection process, the Jury will use, inter alea, the following criteria to determine the winners :

• Respect of the question;
• The quality of the legal argumentation;
• Critical perspective;
• Quality of expression;
• Quality of the language;
• Originality of ideas.

5.4.     The Jury reserves the right not to award one or many prizes if the quality of the Essays submitted is insufficient.

5.5.     The participant may lose a position in the final standings if the quality of the language is not satisfactory.

6. ANNOUNCEMENT AND AWARD CEREMONY

6.1.     The winners will be announced and will receive their prizes in the fall of 2010.

6.2.     Only the Authors of the three (3) best Essays will be contacted. The winners’ names will be available on the official site of CBA-Quebec at www.abcqc.qc.ca.

6.3.     The prizes will be given in form of cheques in the name that the winners would have provided..

In case of discrepancy between French and English version of the present Participation Rules, the French version will prevail.
