Synopsis

The recent federal budget proposes several amendments to the powers of the Canada Revenue Agency (“CRA”) to collect information from taxpayers for purposes of the administration of the Income Tax Act and other federal tax statutes. These proposals include a power to compel taxpayers to provide information and documents under oath, and new measures to address non-compliance with audit requests, including the issuance of “notices of non-compliance”, imposition of penalties for non-compliance and extensions of the normal reassessment period.

Michelle Moriartey discusses the scope of these proposals, legal and practical concerns, and the expected impacts on taxpayers and their advisors in their communications with the CRA.
