Achieving an appropriate balance between the power of police to search and the rights of individual citizens to be free from unreasonable search is vital to our criminal justice system. Viewed more broadly this is an important facet of the constant struggle to achieve balance between individual freedoms and the power of the state. This paper will focus on searches incidental to arrest and strip searches, and the courts’ attempts to strike the appropriate balance in these two specific areas. |
