Professional Development4.2 Children and the LawTuesday, August 19, 11:00 – 12:30 Children are participating more and more in family law litigation. How do we ensure that children's participation is both meaningful and in their long-term best interests? How do we ensure the voices of children are heard in a way that does not give them unrealistic expectations or an unhealthy burden of making choices in the dispute between their parents? A psychologist and a children's lawyer will speak to what kind of participation is most healthy for children and how their voices can be heard in a way that supports their interests, while avoiding the potentially destructive scenarios of over-exposure to family disputes. They will add strategies for effectively representing children's interests by outlining positive and productive ways for children to have a voice and will review the case law regarding when children's expressed views are acted on by the court and when (or why) they are not. |
