4.1 Recent Controversies in Reasonable Accommodation

The issue of reasonable accommodation has recently become topical for a variety of reasons.  In Quebec, many controversies have flared about reasonable accommodation, for example whether forbidding the use of hijabs by women competing in sports events is unreasonably unaccommodating.  On February 8, 2007, Quebec Premier Jean Charest announced the establishment of the Consultation Commission on Accommodation Practices Related to Cultural Differences in response to public discontent concerning reasonable accommodation.  This Commission has conducted an extensive consultation on the topic and will formulate its recommendations in late March 2008.  Issues of reasonable accommodation have caught the attention of the Supreme Court of Canada in recent years as well.  For example, drawing from principles of reasonable accommodation, the Court recently ruled that prohibiting a Sikh student from carrying a kirpan to school infringed his right to freedom of religion:  Multani v. Commission scolaire Marguerite-Bourgeoys, [2006] 1 S.C.R. 256.  The purpose of this panel is to address the recent controversies over reasonable accommodation across a broad spectrum of equality grounds.
