    For the past few years, the CBA and a number of national and provincial sections, including the CBA National Criminal Justice Section, have made access to justice and the proper funding of legal aid a top priority in their dialogue with government.

  • Legal aid: A CBA national initiative

    This year's most important project explored the existence, nature and extent of a constitutional right to civil legal aid. We asked eight noted academics and practitioners to provide legal opinions in support of such a right, and have now published a synthesis of those scholars' findings called Making the Case: The Right to Publicly Funded Legal Representation in Canada.

  • Motion of Non-Confidence in Attorney General of British Columbia Passed
    - By Michael Mulligan
    On May 22, 2002 in excess of 1,140 lawyers attended a Special General Meeting of the Law Society of British Columbia and passed a resolution of non-confidence in Attorney General Geoff Plant. This extraordinary event was precipitated by the Attorney General's failure to meet an overriding obligation to protect access to justice.

  • Court ordered funding decisions are "costs" for s. 676.1 purposes
    On June 20, 2002, the Supreme Court of Canada released its decision in two cases dealing with court ordered payment of counsel's fees. In R. C. v. Quebec (Attorney General), 2002 SCC 52, a superior court judge ordered the Minister of Justice and Attorney General of Quebec to pay a defence lawyer's fees, at the legal aid tariff rate, notwithstanding that R.C.'s financial circumstances placed him marginally above the financial eligibility cut-off under the legal aid plan.
