Mortgage Instructions Toolkit – Seeking Your Input

The CBA Real Property Section is preparing a resource for lawyers dealing with lenders’ mortgage instructions.

A committee of the CBA Real Property Section will review the various instructions lawyers receive from lenders, comment on the ability or appropriateness for lawyers to provide the requested assurances or opinions, and propose standard responses to lenders.

This resource – a mortgage instructions toolkit – will be based on the collective input of the CBA Section's members. Your input can assist all lawyers dealing with mortgage instruction issues by building a collective and respected voice to speak from. We hope that our work will lead to a dialogue with lenders to address these issues. We aim to make lawyers aware of the extent of the issues and associated risks and give lawyers the rationale and proposed language to protect themselves.

To assist us in preparing the most useful resource for your practice, please provide us with:

  1. Copies of instructions you have received from lenders
  2. Your comments about requests that have been made of you
  3. Your own responses to lenders on troublesome requests
  4. Any other comments or opinions you have on the matter
