ONE VOICE ON ELDER LAW ISSUES

The objectives of the CBA Elder Law Section are to:

  • Improve the law affecting seniors
  • Educate the public, individual bars, the judiciary and CBA members on elder law issues
  • Foster communication and professionalism in the field

We aim to stimulate interest in the elder law field. Our Section studies case law regulations and legislation affecting this emerging area of practice, and encourages informed discussions on these issues. We also recommend substantive and procedural improvements in laws affecting the elderly.

The CBA Elder Law Section addresses legal issues and problems, such as:

  • Age discrimination
  • General planning for aging
  • Elder abuse and exploitation
  • Undue influence
  • Housing of older persons and care facility regulation
  • Ethical and practical aspects of advising the older client
  • Mental capacity and consent
  • Guardianship and court appointed substitute decision making
  • Health care decision making
  • Powers of attorney/mandates
  • Elder divorce and separation
  • Lawyer referral panels
  • Advocacy and pro bono work for the elderly of low or middle incomes

We promote older persons’ legal rights to enjoy their families, communities and lives to the fullest extent possible— and inform older persons of these rights.
