CBA on regulatory modernization for air transportation

The CBA Air and Space Law Section sent a submission on Regulatory Modernization for Air Transportation to the Canadian Transportation Agency (CTA). The submission was prepared in response to the CTA’s Discussion Paper on Modernizing Regulation for Air Transport

In the submission, the CBA Section applauds the CTA’s regulatory modernization initiative, and comments on the Discussion Paper with a view to streamlining existing tariff and application requirements, enhancing the certainty of legal obligations imposed on carriers, and promoting access to justice. Given the complexities of some of the issues raised in this submission – including tariff regimes, the adjudication process, and prevailing commercial models – the CBA Section recommends that the CTA establish an industry working group for ongoing feedback on these systems and processes.
