About the Section

Who is this Section for? Research lawyers in the private bar, government counsel, counsel to non-profit organizations, sole practitioners specializing in research, legal educators, legal counsel to courts and tribunals, and legislative drafters will all benefit. Members will be kept up to date on rapidly developing areas of law, with presentations by local and international experts, a monthly newsletter, strategic skill development sessions, and enjoyable networking initiatives. This Section will actively build partnerships with other MBA Sections, in an effort to improve the legal research undertaken by all members of the profession.

TOPIC: Legal Research Roundtable
 
Join your Legal Research Section colleagues for the second installment of this informal get together to discuss Section events planned for the upcoming year and to swap research tips. Please bring the legal research resource most indispensable to your practice with you to the meeting (or a link to the site, if online). It might be a textbook or a case law database or an annotated statute or set of rules – it should be the one legal research aide you hope you never have to do without, or the one you consult most frequently. Be sure to invite your firm/department librarian to attend with you, too.

Please RSVP to the Manitoba Bar Association online. You can also call the RSVP Line @ 927-1211 or email (sections@cba-mb.ca) by 4:00pm on Friday, June 8, 2012. Please confirm if you would like lunch (sandwiches) and advise of any dietary restrictions. Lunch will be provided by the Section.

In the adversarial world of labour and employment law, it is always reassuring to know that your research skills are keeping pace with the competition. Please join us for an opportunity to compare your current research practices with those of lawyers in other Canadian jurisdictions. Attendees will also receive a hand-out comparing the various online databases and their coverage of Manitoba labour and employment law decisions.
 
Ms Cotter received her call to the Bar in Manitoba and practiced here for a number of years before obtaining her Masters degree in Library and Information Science. She has been a Reference/Instruction Librarian at the Gerard V. La Forest Library since 2008. She teaches Legal Research at UNB and co-authored the fifth edition of Barron’s Canadian Law Dictionary and the third edition of Carswell’s Practical Guide to Canadian Legal Research.
 
Mr. Broad is a partner at Hicks Morley and serves as chair of the firm's Knowledge Management Group. Previously, he was also a member of the firm’s Research Group. Mr. Broad provides research and support services to other members of the Firm. In addition, Mr. Broad advises clients in a variety of labour and employment areas, with a particular emphasis on employment standards, privacy and freedom of information. He is the consulting editor for Canada Law Book’s Federal Labour & Employment Legislation.

Originalism vs. Dynamism: A Unified Approach to Statutory Interpretation – Randal N.M. Graham - MidWinter 2010

The author uses this paper to combine two existing theories of statutory interpretation to allow for a high functioning, unified theory to be utilized by the judiciary. The paper looks at two theories of statutory construction which are thought to be mutually exclusive and contradictory theories, originalism and dynamic or progressive interpretation. Through analysis of both theories and their strengths and weaknesses, as well as a look at the way they interact with one another the author argues that the two opposing theories are truly two sides of the same coin. He then uses this new theory to examine problems and explains current statutory shortcomings.

 

Recent Manitoba and Supreme Court Cases involving Statutory Interpretation – The Hon. Madam Justice Freda M. Steel & Melanie Bueckert - MidWinter 2010

This paper provides an overview of the approach to statutory interpretation taken by Manitoba’s courts and the Supreme Court of Canada through summaries of their 2008 and 2009 cases. The authors examine differences in the application of statutory interpretation principles from one area of the law to another and within the courts themselves from one judgment to another.
