Immigration and Refugee Protection Regulations: Misrepresentation:
Submission to Citizenship and Immigration Canada

The Section opposed draft regulations that would deem certain information provided by an immigration applicant to constitute misrepresentation under the Immigration and Refugee Protection Act. The Section argued that general deeming provisions cannot be applied with any degree of fairness, accuracy or consistency, given the nature of immigration processing. Further, the proposed regulation would place inappropriate limits on the right to appeal.
