Impact of Federal Court Class Action Rules on Lawsuits by Aboriginal Nations :
Letter to Federal Court Rules Committee

Aboriginal Law Section and Federal Bench and Bar Liaison Committee

The CBA National Aboriginal Law Section expresses concerns to the Rules Committee of the Federal Court on the impact of Federal Court class action rules and on the effect of the repeal of the representative actions rule in the Federal Court. The CBA Section say that the repeal of the representative action will have an adverse effect on the ability of First Nations to advance their claims in the most efficient and appropriate manner. The CBA Section requests the Rules Committee consider the reimplementation of representative actions as an alternative to class actions in certain circumstances.
