Employment-Related Class Action Litigation

This webinar will explore the current class action regime in Canada and how we have seen it used in the employment law context. We will look at some of the challenges faced in launching this type of litigation, and where plaintiffs have been successful in bringing forward these claims.
Our panel is comprised of experienced class action counsel, including counsel from the United States, who will help to shed light on some of the strategies used in employment-related class action litigation by our neighbours to the south.

Budget Implementation Act (Bill C-45)
The new Budget Implementation Act (Bill C-45), also known as the "Jobs and Growth Act, 2012" passed third reading on December 5, 2012 in the House of Commons, was introduced in the Senate on December 6, 2012 and received Royal Assent on December 14, 2012.
Sections 219 to 232 of the Bill propose amendments to Part III of the Canada Labour Code.
Although it is impossible at this time to know whether there will be any amendments to this Bill and when it will come into force we are highlighting below some of the key amendments found in this Bill:
The Bill:
- Simplifies the calculation of holiday pay;
- Stipulates that vacation pay would have to be paid within thirty days following the day on which an employee ceases to be employed;
- Formalizes the procedure for filing a complaint under Part III with an inspector, including:
- the time limits for making certain complaints under Part III; and
- the reasons for which an inspector may dismiss a complaint;
- Restricts the period that may be covered by payment orders. In particular, a payment order for recovery of wages or other amounts is limited to a maximum period of 12 months before the date on which the complaint is made and to a maximum period of 24 months in the case of vacation pay;
- Creates a review process of an inspector's payment order or notice of unfounded complaint;
- Contains some "housekeeping" changes to the vocabulary.
The Executive of the National Labour and Employment Law Section has decided not to present submissions or comments on this Bill.
